The City of Miami Beach has been discussing a short term rentals ordinance for apartments in multi-family districts of Miami Beach since last year. Originally, the city wanted to ban all short term rentals in Miami Beach; however, when they found themselves faced with so many threats and much opposition from owners, they quickly realized they could not simply deny owners their property rights.

In 2008, the City of North Miami passed an ordinance to ban short term rentals with the exception of those operated by owners whose rights were "grandfathered" in from legally renting short term rentals prior to the ordinance.



The new ordinance regulates short term rental in Miami Beach activity and puts restrictions and regulations on vacation property owners such as:

  • A minimum requirement of 1 week rental
  • The condo building must allow (not-prohibit) short term rentals
  • Property manager must be recognized by the City of Miami Beach
  • Manager’s contact information must be provide for renters and neighbors
  • Registration and a license must be granted by the City of Miami Beach
